In California a mortgage company must follow certain legal procedures and time periods in order to foreclose on your home. We can review the foreclosure to determine if the foreclosure followed the necessary legal procedures. When a mortgage company chooses to foreclose on your home through a non-judicial foreclosure, they must first provide you with a Notice of Default that is recorded with the county recorder. They must wait 3 months from the date of this notice to issue a Notice of Sale Date. The Notice of Sale Date must also be recorded with the county recorder and must set the sale date at least 21 days from the date of the notice. During this period you can file for bankruptcy protection and stop the foreclosure of your home.
